Privacy Policy

1. General Provisions

1.1. The CF “CHARITABLE FOUNDATION ‘POTRIBNI'” (hereinafter referred to as the “Fund”), acting as the Owner and Administrator of personal data under the Ukrainian Law “On the Protection of Personal Data,” conducts charitable activities according to the Ukrainian Law “On Charitable Activities and Charitable Organizations” by providing charitable assistance in the areas defined in the Fund’s Charter and in accordance with the Charitable Program and Charitable Projects implemented by the Fund, using funds and property received from legal entities and individuals (hereinafter referred to as “Donors”) in the form of charitable donations, including through public fundraising on the Fund’s website https://potribni.com/ (hereinafter referred to as the “Website”).

1.2. When any individual visits the Website, the Fund receives certain information about them. This Privacy Policy (hereinafter referred to as the “Policy”) applies when an individual:

  • visits this website;
  • registers on our website to receive charitable assistance;
  • makes a charitable donation;
  • provides the Fund with their personal data in another way for communication purposes.

1.3. This Policy outlines the types of information and personal data that the Fund receives from visitors to the Fund’s website, the procedures for their collection, processing, and use. Information and personal data are collected, processed, and used in strict accordance with the current legislation of Ukraine.

1.4. The Fund reserves the right to make changes to the Policy at any time and for any reason, without additional notice to visitors regarding the respective changes.

1.5. Providing/posting information on the Website constitutes the visitor’s consent to the content of this Policy and means that the visitor consents to the Fund collecting, using, and distributing information that identifies them according to this Policy.

If you do not agree with the terms of this Policy, do not send us any information and immediately cease using the Website.

2. Types of Information the Fund May Receive

2.1. The Fund collects information related to the visitor only if the visitor has voluntarily provided such information or has explicitly consented to its provision and/or use. The information the Fund collects includes:

  • Personal Data: We may collect information that identifies you (hereinafter referred to as “Personal Data”) when you choose to interact with us and provide such information through feedback or by filling out contact or registration forms on the Website, or otherwise provide this information through the Website, including by submitting requests, making donations through the Website, etc. Personal Data includes, but is not limited to, information about your name, phone number, residential address, email address, your document details, and other similar information.
  • Secondary (Technical) Data: When you visit the Website, certain data is automatically recorded on the Fund’s servers for system administration, as well as for statistical or backup purposes using a variety of technologies, including, but not limited to, cookies, tags, IP tracking/URL tracking, and other tools. The recorded information may include the name of your internet service provider, in some cases your IP address, data about the version of your browser software, the operating system of the computer from which you visited the Website, the addresses of websites you visit simultaneously with our Website, and, if possible, your search parameters that led you to the Website, timestamps, click counts, viewed advertisements, and so on. You can block or disable cookies on your computer, which will limit the collection of Secondary Data done through cookies, but in this case, you may not be able to use certain features of the Website, and your user experience may be negatively affected.
  • We may also use other tracking services (third-party programs) such as Google Analytics to understand and research the conditions under which you use our Website. Please note that in Google Analytics, information sent by your browser as part of a webpage request, including cookies and your IP address, is collected. In this case, Google also receives this information, and its use is governed by Google’s privacy policy and/or the Google Analytics software operator; we are not a party to your relationship with third parties such as Google Analytics operators.
  • Payment Information: We do not directly collect information about your payment methods, such as bank cards, etc. If you wish to make a donation through the Website, you will be redirected to the website of a third party—a payment operator—through which such a payment can be made, and your payment details will be provided not to the Fund but to the operator of such a payment operator. Please note that your data will be processed by such a third party in accordance with its privacy policy or other agreement entered into with you. We are not a party to your relationship with third parties such as payment system operators.
  • Personal Data of Children: We do not wish to collect information about visitors who are under the age of 18. If parents or other legal representatives of a child discover that the child has provided certain information to the Website and believe that such data should be deleted, upon their request, we will take steps to delete such information.

3. Use of Information We Receive

3.1. Your personal data and other information you provide are used only for the purpose for which you provide them to us.

3.2. We will use the information you provide to support and organize communication with you, send you correspondence, notifications, and information, maintain our databases, including contact databases, visitor databases, donor databases, etc., conduct statistical, sociological, and other research, create contracts and other documents necessary for our relationship with you, prepare reports required by current legislation, and prevent violations of confidentiality, legal norms, or contract terms.

3.3. We do not sell information to third parties.

3.4. Any information received from visitors may be transferred to third parties only in cases provided for by the current legislation of Ukraine.

4. Data Security

4.1. The Fund undertakes to carefully store the information and data provided by you securely and to take all precautions to protect the information from loss, misuse, or unauthorized alteration. However, no method of transmitting information over the Internet or mobile communication or electronic storage is 100% secure. Despite our efforts, we cannot guarantee or ensure the security of any information you transmit to us through our Website.

4.2. You acknowledge that you understand the risks described above, particularly that the information you provide may be lost or obtained by third parties, and you personally and independently bear all risks associated with this.

5. Dissemination of Information We Receive to Third Parties

5.1. We may transfer the information you provide to third parties only to the extent objectively necessary to achieve the purpose described above, or to protect the security or integrity of our Website, take preventive measures against liability, or assist in legal proceedings or requests from other government agencies; or in cases where we believe it is necessary to provide such information to prevent physical harm or financial loss, or in connection with an investigation into suspected or actual illegal activity.

6. Your Data Processing Requests

6.1. The Fund confirms that you have the right to access your personal data and complies with your requests when necessary. You have the following rights:

  • You can request access, correction, updating, or deletion of your personal data collected during the use of the Website.
  • You can request additional information regarding the purposes of processing your personal data; the types of personal data processed; the locations of primary collection of personal data; the entities to whom the Fund grants access to personal data; and the retention period of personal data by the Fund.
  • You can object to the processing of your personal data, request the Fund to restrict the processing of your personal data, or request the transfer of your personal data.
  • In cases where the Fund collects and processes your personal data based on your informed consent, you may withdraw your consent at any time. However, withdrawing your consent will not affect the lawfulness of any processing of personal data carried out by the Fund before your withdrawal, nor will it affect the processing of your personal data based on other legal grounds for processing personal data.
  • At your request and if technically possible and legally justified, the Fund will provide you with a copy of your personal data or transfer it directly to another administrator (owner). You have the right to file a complaint regarding the collection and use of your personal data with the data protection supervisory authority.

To send a request, please send an email to the Fund at cf@potribni.com with the subject “Request for Personal Data” and provide the Fund with complete information about your request, including your contact information and any other details you deem relevant. The request should include:

  1. Surname, first name, and patronymic, place of residence (stay), and details of the document confirming the identity of the person making the request (for a natural person – the applicant);

  2. Surname, first name, and patronymic, as well as other information allowing the identification of the person for whom the request is made;

  3. Information about the personal data database to which the request relates, or information about the owner or administrator of personal data;

  4. List of requested personal data;

  5. Purpose and/or legal basis for the request.

The Fund will respond to a request for access within 30 days of receiving such a request regarding the personal data held by the Fund, or if the Fund is unable to provide such data within the specified period, the Fund will notify you and explain the reason for the delay.

You may also have other rights provided by current legislation.

Identity Verification Requirement: The Fund is required by law to verify that any request was submitted by a person with a legitimate right to access the data. Therefore, before providing any information in response to a data subject’s request for access to personal data, the Fund may ask you to provide additional information to confirm your identity and legal authority.

7. Privacy Questions

You have the right to report privacy-related complaints to the national data protection supervisory authority. In Ukraine, this is the Commissioner of the Verkhovna Rada for Human Rights.
